DUI Under 21 Is Not the Same as DWI — But It’s Not Minor Either
Texas has a zero-tolerance standard for drivers under 21: any detectable amount of alcohol in a minor’s system while driving is sufficient for a DUI charge under §106.041 — no specific BAC number required. A driver does not need to be impaired. They do not need to blow 0.08. Any traceable amount of alcohol triggers the offense.
The charge is a Class C misdemeanor — no jail time, maximum $500 fine. But the consequences extend well beyond the fine. A first conviction means a 60-day license suspension, 20–40 hours of community service, mandatory attendance at an alcohol awareness course, and a record that affects college applications, scholarship eligibility, and employment background checks.
When DUI Under 21 Can Become DWI
If the driver’s BAC is at or above 0.08 at the time of arrest — regardless of age — the charge can be filed as a standard DWI (§49.04) rather than a juvenile DUI. Prosecutors have discretion in how to charge a minor caught at or above the legal adult threshold. An attorney examines which charge was actually filed and whether the evidence supports it.
College and Academic Consequences
For a university student, a DUI conviction can trigger disciplinary proceedings at the institution, affect financial aid eligibility, and appear on background checks for internships and employment. The criminal record consequence is often more significant than the fine. Deferred adjudication or dismissal avoids a conviction — both are worth pursuing aggressively at this charge level.
